Booking:
The booking terms and conditions form the sole contract between "We" (the owner & their Management Company) and the person signing the Booking form, who must be over 18 years of age and who shall be deemed to sign this form on behalf of all the persons herein. No contract shall exist until we have received a signed booking form together with the correct deposit/full payment, and we have confirmed the reservation in writing. Before booking it is recommended that you telephone, fax or send an email to check availability, giving if possible, a second choice departure date. Your booking can be made provisionally, if required, and held for a maximum of 7 days to allow time for your completed booking form and deposit/full payment to be received. The balance should be paid not later than 8 weeks before departure. If a booking is made within the 8-week period, full payment must be received before the booking can be confirmed.  

Refundable Security Deposit:
A security/breakage deposit of $400 / £260 should be paid with your final balance. This is to cover excessive use of electricity (e.g. air conditioning on full with external doors left open), excessive cleaning costs (including those caused by pets) and chargeable telephone calls, and also covers for damage, breakage and loss to the villa and contents and for lost keys, which necessitates changing locks.  We reserve the right to increase the security deposit at our discretion & will advise the signatory as such prior to booking. The security deposit less any such charges will be refunded, by cheque, as soon as the Management Company has completed its inventory and occupancy report. This will normally be soon after the 18th of the following month. The signatory on the booking form will be liable for all damage and loss to the villa during the rental. The Management Company reserves the right of entry at any time.  

Arrival & Departures:
The rental period begins at 16.00 hours on the day of arrival and terminates at 10.00 hours on the day of departure. The villa is professionally cleaned and inspected before and after each rental to ensure that all guests have a comfortable stay. Lawn and Pool care are provided on a weekly basis.  

Rates:
The accommodation rates quoted are PER WEEK (not per person), and include electricity, air conditioning, heating (when applicable), local telephone calls, cable TV (excluding Pay-for-View), bed linen, towels, the use of all the amenities and facilities. FLORIDA SALES AND TOURIST TAX MUST ALSO BE PAID IN ADDITION TO THE RATES QUOTED.   

Cancellation Policy:
Cancellations must be confirmed to us in writing. E-mail cancellations are not acceptable. In the event that you cancel your reservation, or we have to cancel the arrangements due to non payment of the balance due within the time allowed before departure, cancellation charges will be made as follows;


Booking Deposit Non-Refundable

8-6 weeks before arrival date = 50% Deducted
6-4 weeks before arrival date = 75% Deducted
4 weeks before arrival date    = 100% Deducted

Smoking & Pets:
Please note that SMOKING IS NOT PERMITTED INSIDE THE VILLA, though it is permitted on the patio area by the pool. This keeps the villa odour free and also avoids the trouble of the sophisticated smoke detectors being triggered by the cigarette smoke. If the Management Company discover evidence of smoking in the villa, this will be taken into account when assessing your security/breakage deposit, and your co-operation is therefore requested and appreciated.

Well-behaved pets will be considered only at the owners' discretion at the time of booking. The refundable security deposit will be increased to $600 / £400. 

Responsibilities:
The accommodation may only be sub-let, shared or assigned by you with our express agreement, otherwise only the persons detailed on the booking form are permitted to stay in the villa. The maximum occupancy is 14.  The authorities within strict guidelines for fire safety determine this. Please note that contravention of the above will render your booking void and all monies will be forfeited.  

Liabilities:
Force Majeure: We accept no responsibility or liability for any loss or damage or alteration to the terms of your reservation caused by events beyond our control, including, but not restricted to, war, terrorist activity, civil commotion, flight delays or cancellations, airport closures, adverse weather conditions, fire, flood, or industrial dispute.

We cannot accept any liability for failure of public supplies such as water, electricity or air conditioning or failure of the swimming pool equipment. Nor for the consequences of the actions or omissions of persons who may control or supply main services, or any actions taken in the vicinity of the property reserved, by any authority over which there is no control. This does not affect your statutory rights as a consumer.

We cannot accept any liability for your personal safety during your holiday vacation. You are reminded to exercise care as to your personal safety, and the safety of your companions. Whenever possible, valuables should be left secure and out of sight. 
All descriptions given on the web site are made in good faith, but no liability can be accepted for errors or omissions.

We accept no responsibility or liability whatsoever for death, personal injury, sickness, accident, delay, loss or damage to luggage or personal effects or any other loss or misadventure that may occur whilst renting one of our villas. It is particularly important that children are supervised at all times in and around the pool areas as the pool's depth is between 5 to 6 feet. DO NOT LEAVE CHILDREN UNATTENDED.

Insurance:
You are strongly recommended to take out travel insurance as soon as your reservation is definite, to provide adequate protection against delays, cancellation & loss or damage to your personal possessions or baggage.

Passports & Visas:
ALL CLIENTS SHOULD POSSESS VALID PASSPORTS AND ANY VISA REQUIRED. British citizens require a full 10-year passport valid for a period of at least six months beyond the holiday/vacation return date and all persons, including babies, are required to have their own passport. The majority of visitors to the USA from Britain no longer require a visa as a result of the Visa Waiver Programme. It is, however, the holidaymaker's responsibility to make sure that they have all the correct travel documents. If you have nay queries you are advised to contact the US Embassy for details. We cannot accept liability for any aforementioned conditions not being met or any refusal of passage.


Code Of Conduct:

We reserve the right to decline or retain any person as a client whose conduct is deemed to be disruptive and affects the enjoyment of other holidaymakers/residents. We shall be under no liability to accept any costs incurred, or responsibility for, any such person. Rolling Hills is a residential community. Please do not use the swimming pool, play loud music or engage in any activity that may cause inconvenience to your neighbours after 10:30 pm or before 07:30 am . 

Complaints:
Should you experience any problems whatsoever with the villa during your stay, please contact the Management Company, who will endeavour to do their best to assist and rectify the matter as soon as it is practically possible. Should a problem remain unresolved, you are asked to notify us in writing within 7 days of your return. No action can be taken or liability accepted for any complaints received after this period. We aim to resolve complaints within a 2-month period from receipt, the details of which will be kept confidential to only the parties involved.
 
Please note that, as Florida is a tropical State, insects such as ants and the like are occasionally inevitable, and are not cause for complaint. The villa is treated periodically as part of a pest and termite control programme, and is cleaned after each rental. 

Law:
The contract made is governed by, and shall be interpreted in accordance with English Law, and the parties hereto shall submit to the jurisdiction of the English Courts.

Privacy Policy:
Any information passed on by visitors to this site, for example, customers completing on-line booking forms or submitting their email address will be used solely for the purpose of renting the villa. We will not pass your details on to any other agencies or third parties whatsoever and will at all times respect the privacy of our clients.
